Upcoming New York Sports Betting Sites

On January 2023, New York lawmakers proposed Bill S1962 - an amendment that would expand the state’s total number of online sports betting operators from nine to fourteen by 2024 - and to sixteen by 2025.

If approved, this bill would give several big names in sports betting the chance to apply - or re-apply - for the chance at an operating license in the Empire State.

bet365 New York

While bet365 applied to be one of the first licensed operators in New York, the New York State Gaming Commission denied Bet365 its request back in November 2021.

In their bid to make this happen, bet365 had already created a partnership with the Resorts World Catskills to develop a physical and online sportsbook, however, this was not enough to sway the Gaming Commission.

There has been plenty of talk, however, of bet365 becoming the 10th New York sports betting operator once NY expands the number of betting licenses, and bet365 is rumored to already be preparing their bid for when this happens.

ESPN Bet New York

One of the most iconic brands in sports, ESPN is throwing their hat into the sports betting ring with their newest brand, ESPN Bet. After acquiring Barstool Sports and its existing licenses in August, they're gearing up to launch in 16 states by Fall 2023.

Unfortunately, New Yorkers will have to wait a bit longer before they can play with ESPN Bet, as Barstool doesn't currently hold a license in the Empire State - putting a temporary hold on ESPN Bet's debut in New York.

However, ESPN Bet surely have their eyes firmly set on New York's pending legislation. Should Bill S1962 pass, ESPN Bet is almost certain to be one of the main contenders for one of the additional licenses.

As of the time of writing, New York is the largest legal sports betting state in the United States.

Regulated by the New York State Gaming Commission, licensed New York sports betting offers players the chance to bet on sports events safely and fairly, using secure transactions.

The initial groundwork for sports betting legalization in New York was laid in 2013 with the New York Gaming Economic Development Act, a constitutional amendment that created a framework for future sports wagering, contingent upon changes in federal law.

These changes occurred in 2018 when the U.S. Supreme Court overturned PASPA, freeing states to legalize sports betting.

By the summer of 2019, the New York State Gaming Commission gave the nod to four upstate commercial casinos to offer in-person sports betting. Online betting was not part of this initial rollout, however.

It would take two more years until, in April 2021, Governor Andrew Cuomo signed legislation authorizing the state to issue licenses for legalized mobile sports betting. Requiring all mobile operators to be affiliated with state-licensed commercial casinos, this law allowed New Yorkers to place their bets online from anywhere within state lines.

In January 2022, a wave of online sportsbooks including FanDuel, Caesars, DraftKings, and BetRivers, entered the market. The original 4 were joined shortly after by BetMGM, PointsBet, WynnBET, and Resorts World Bet. Bally Bet, the ninth operator, joined the New York market in July 2022, completing the first wave of licensed online sportsbooks.

    In order to place sports bets in New York you must be at least 21 years old. However, you are permitted to wager on horse racing or play the lottery as early as 18 years old.

    You are allowed to register and make a deposit remotely on any of the 9 NY licensed sites from anywhere in the United States. However, in order to place wagers you will need to be located within the borders of NY state.

    High School Sports Betting in NY

    Unlike College Sports, betting on High School ball games is categorically illegal in New York - just as it is in the rest of the US. Any event that involves amateur athletes under 18 is expected to remain off-limits for the foreseeable future.

    Politics Betting in New York

    A favorite of many NY bettors, betting on politics is a tradition that stems back to 1868.

    Unfortunately, any kind of political event or election betting is currently forbidden by the New York State Gaming Commission.

    While many consider esports to be a type of legitimate sport, the New York Gaming Commission does not agree with this assessment, and they do not permit betting on esports events.

    New York Sports Betting Taxation

    When it comes to online betting in New York, the house may win some and you may win some too, but there is only one entity that will always come out on top: the Taxman.

    The main motivator for the state of New York to legalize sports betting, New York’s legislation taxes both operators and players on any winnings they accrue due to their sports betting activities.

    New York Betting Tax for Operators

    While New York state only taxes land-based sports betting at 10%, all licensed mobile operators are taxed at the astronomical rate of 51% of the sportsbooks’ gross gaming revenue (GGR) - by far the highest of any state in the US.

    While this tax added an additional $692.8M to New York’s coffers in 2022 alone and is seen as highly beneficial to the state, it does have the downside of making it more difficult for online sportsbooks to turn a profit in the state.

    However, the New York State Senate and New York State Assembly have introduced bills that, if passed, could potentially lower the taxes down to 25% by 2025.

    You may be thinking “Why should I care if sportsbooks turn a profit?” - which is fair. However, it does affect bettors in a few important ways:

    1. Most operators in New York offer significantly lower bonus promos than they do in other states, as they cannot afford to splash as much cash around.
    2. Some operators may decide to higher their juice, giving less attractive prices to bettors.
    3. If operators cannot turn a profit, many of them will opt to leave the market and focus on other states, decreasing the amount of betting options available for New Yorkers.

    Responsible Gambling in New York
